1. Scope of the Service
This Buy, Sell & Swap page (the “Member Marketplace”) is a free service provided exclusively for registered members of the Golf For Greys Golf Society. The purpose of this platform is to allow members to list, buy, sell, or swap personal, second-hand golf equipment on an occasional basis.
2. Complete Disclaimer of Liability
- The Society’s Role: Golf For Greys acts strictly as a passive host for advertisements. The society does not participate in, control, vet, or handle any transactions between buyers and sellers within the Member Marketplace.
- No Warranties: Golf For Greys gives no guarantees regarding the condition, authenticity, safety, or quality of any items listed. All items are sold “as is.”
- Waiver of Claims: By using this Member Marketplace, you agree that Golf For Greys, its committee, and website administrators are entirely free from liability for any financial losses, faulty equipment, fraudulent listings, or disputes arising from a transaction.
3. Private Sales Only (No Commercial Trading)
- Private Individuals: This Member Marketplace is strictly for peer-to-peer (particular a particular) sales of personal items. Commercial trading, businesses, or individuals “flipping” golf gear for profit are strictly forbidden from listing items.
- Portuguese Consumer Law: Users must note that because these are private sales between individuals, Portuguese consumer protection laws (including statutory warranties and the right to a 14-day return window) do not apply. All sales are final under the principle of caveat emptor (buyer beware), unless agreed otherwise between the buyer and seller.
4. Listing Rules & Accuracy
- Honest Representation: Sellers are legally required under the Portuguese Civil Code to describe items accurately. You must disclose any known defects, cracks, or heavy wear (especially regarding graphite shafts or clubheads).
- Authenticity: Listing counterfeit, replica, or cloned golf equipment is illegal under Portuguese law and will result in an immediate ban from the Member Marketplace and potential disciplinary action by the society.
5. Payments, Shipping, and Safety
- No Online Payments: The Golf For Greys website does not process payments, hold funds, or offer escrow services for transactions made through the Member Marketplace.
- Safe Transactions: To prevent fraud, we highly recommend that all transactions are finalised in person and in cash (or immediate MB Way/bank transfer).
- Shipping Risk: If members choose to ship items using CTT or a courier, they do so entirely at their own risk.
6. Modification and Removal of Listings
The website administrators reserve the right to remove any listing from the Member Marketplace at any time, without prior notice, if it violates these terms, is deemed inappropriate, or if the item has successfully been sold.
